My loved one developed pneumonia at a nursing home- Do I have a claim?

Transcript:

If your loved one developed pneumonia at a nursing home, you may be able to sue the nursing home for neglect. Pneumonia can be difficult to diagnose, but there are steps nursing homes can take to lower the risk of residents developing pneumonia. If a nursing home neglects to take the right precautions in preventing residents from developing pneumonia, then that facility may be liable for related medical expenses and pain and suffering.

Pneumonia is one of the leading causes of mortality in nursing homes, and a main reason many nursing home residents transfer to hospitals. In elderly people, pneumonia can be difficult to diagnose, which is why nursing homes sometimes fail to catch it right away. Studies show that nursing home residents who use feeding tubes are more susceptible to certain kinds of pneumonia, and a lack of adequate dental care also greatly increases a person’s risk of developing pneumonia.

Because of its potentially serious nature, nursing home staff and caregivers should use reasonable care to prevent residents from contracting pneumonia. Good oral and dental hygiene is one of the most effective ways to prevent pneumonia, so nursing homes should do all they can to ensure that their residents receive adequate dental care.

Additionally, caregivers and nursing home staff should follow general health and sanitation practices, like frequent hand washing and sanitation of hard surfaces. Nursing homes should regulate resident activity to ensure that those with weakened immune systems are not exposed to germs, and staff should make sure residents maintain good health through a nutritious diet, adequate rest, and opportunities for mobility. When pneumonia is diagnosed, nursing home staff should administer treatment – which usually involves antibiotics – as soon as possible.

If a nursing home fails to follow these practices, and a resident develops pneumonia, then that facility may be liable for any consequences. This means the nursing home may be responsible for medical bills, out-of-pocket expenses, and related pain and suffering.
