A nursing home complaint doesn’t have to be centered on a facility. It can be targeted directly at the medical professional responsible for the damage. Good nursing homes work with state officials to prosecute those responsible for harming our elders. Today’s story is a good example.
A certified nurses assistant from United Hebrew Geriatric Center in New York has been arrested for allegedly dropping an 85-year-old patient from a mechanical lift. The patient sustained injuries to her nose, temple, and shoulder. According to the complaint, the patient was totally dependent on others for physical movement. To move her from a bed to a wheelchair required a mechanical lift and two assistants. The CNA in question tried to do it alone, despite training.
The CNA is charged by felony complaint with Endangering the Welfare of an Incompetent or Physically Disabled Person in the First Degree and Endangering the Welfare of a Vulnerable Elderly Person, or an Incompetent or Physically Disabled Person in the Second Degree, both Class E felonies, and two counts of Willful Violation of Health Laws, Class A misdemeanors. She faces up to four years in prison.
She could also face civil charges from the family of the elder. Families use nursing homes to help their loved ones get care they can’t provide themselves. When that duty of care is violated, those who are responsible should pay.
