Sometimes a family will come to our office with stories of nursing home negligence. However, at that time, the family might not know the exact ways in which the nursing home is negligent.
For example, we recently had a family inform us that their mother, a nursing home resident, was not being changed or fed enough. After investigating medical records, clinician notes, and other documents, we learned very quickly that the mother had bed sores, also called decubitus ulcers or pressure sores, on her buttocks. The family had no idea about these injuries or the fact that the sores had caused sepsis. Unfortunately, the sepsis became so bad that she eventually lost her leg.
There was some challenging of the evidence by the nursing home’s insurance company, which is normal. The nursing home blamed the loss of leg on the mother’s diabetes. We put the records in the hands of our experts, who disagreed.
In fact, the amputation was required as a result of the infection of the blood that was more likely than not caused by the ulcers.
Long story short, the family thought that their claim was that their mother was not being changed or fed, which is partly true, but there was much more to the story. With our help, the family was able to uncover what really happened.
As a result, we were able to work out a sizeable settlement for the family.
